Seiche Training Terms and Conditions

1 General

All materials presented by Seiche Training Ltd are for educational and professional development purposes. Whilst Seiche Training Ltd endeavours to ensure these materials are as accurate and useful as possible, it does not accept any liability to any person for the information or advice (or the use of such information or advice), which is provided on the course or incorporated into it by reference.

Seiche Training Ltd does not necessarily endorse any of the organisations and/or programs/resources presented on this course. Delegates should seek their own legal advice when investigating or responding to specific issues.

The intention of the Passive Acoustic Monitoring Seiche Training Ltd courses is to improve the dissemination of information and operating skills to operators concerned with Passive Acoustic Monitoring Equipment. Seiche Training Ltd is not responsible for the actions or impact of the operators outside of the training environment.

Seiche Training Ltd courses are delivered in English and at a fast pace. If a delegate feels that this could be challenging for them, they may need to make any alternative arrangements to accommodate their own needs in this regard.

Seiche Training Ltd reserves the right to make such alteration to the content of a course as may be necessary.

Strict minimum and maximum numbers apply to training events.

2 Vessel

Some of Seiche Training Ltd.’s courses require delegates to board a vessel. If this is the case for the course the delegate is booked on, the delegate shall need to bring with them all necessary travel documents such as passports and visas before boarding the vessel. Should the delegate not have the appropriate documentation, the delegate will not be allowed to board the vessel. Seiche Training Ltd takes no responsibility for restrictions imposed due to incorrect documentation. Seiche Training Ltd accepts no liability for any course delegates left dockside should they be prevented from boarding the vessel.

Course delegates must be fit and appropriately attired to board the vessel. Seiche Training Ltd takes no responsibility and no liability should the Captain of the vessel refuse to allow a delegate to board the vessel due to concerns over fitness or inappropriate attire. If the Captain refuses to allow a course delegate to board for fitness reasons or inappropriate attire, no refund will be paid.

The vessel’s Captain has the right, at their full discretion, to prohibit items from being brought on board that may pose a safety hazard. These include, but not limited to utensils, tools, flammable substances or any other items that the vessel’s personnel identify as a potential threat to safety.

The vessel’s Captain may, at any time, without notice or liability for payment or compensation, cancel the training event, change the time of sailing or arrival, change the place of embarkation or disembarkation or shorten the training event. Course delegates shall have no claim against Seiche Training Ltd and Seiche Training Ltd will not be liable for damages or refund for travel expenses, delay, inconvenience, and disappointment or expense whatsoever in such circumstances.

Course delegates shall be responsible for complying with the requirements of all immigration, port, health, customs, police and university authorities, and all other laws and regulations. Course delegates agree to reimburse Seiche Training Ltd for any expenses or fines that may incur because of non-compliance. Course delegates must always obey all the rules regulations and orders of the vessel, Seiche Training Ltd and the Captain.

3 Responsibility to inform Seiche Training Ltd of Disabilities or Pregnancy

At the time of booking, course delegates are required to inform Seiche Training Ltd of any existing medical, physical or mental illness, disability, pregnancy or any other condition which may require medical attention or the use of a wheelchair during the course on land or at sea. If any such condition arises after the course delegate has booked the course, the course delegate must report the condition to Seiche Training Ltd as soon as they become aware of it. Failure to report any such condition shall release Seiche Training Ltd or the vessel’s Captain and all other personnel from any liability related to the accommodation or treatment of such a condition or for any other conduct whatsoever in connection therewith. The vessel’s Captain may refuse to embark the course delegate should they require medical attention.

4 Personal Effects

All personal effects are carried at course delegates own risk. Course delegates are responsible for their own insurance arrangements. Seiche Training Ltd will not be liable for any loss of or damage to cash, jewellery, objects of a precious nature, electronics, cameras, binoculars, mobile devices, dental hardware, eye glasses, documents or any other personal property.

5 Qualifications of Participants

Registrants on courses should note that successful completion of such courses requires participants to demonstrate an understanding of the underlying principles and competence in the selection, administration and feedback of the instrument(s) concerned. Whilst Seiche Training Ltd will make every reasonable effort to ensure a high standard of training and impartiality in such awards, no guarantee is given that every participant attending will receive such qualification.

6 In-House Training Courses

In-House training course programs can produce significant savings where a client has several participants wishing to attend public training courses Fees for these courses will be provided on request. There is a maximum delegate requirement of 6 delegates or a minimum charge equivalent to having 6 delegates.

The details and requirements for the in-house course will be agreed at the time the course is booked. In general, however, in addition to the agreed course fees we ask the client to provide and/or pay for the following:

  1. The training venue. audio and visual equipment.
  2. All meals and refreshments during the course.
  3. Travel and accommodation for the trainer(s)
  4. The cost of transport by courier of equipment and materials to and from the venue.
  5. Other terms and conditions will be as for the Public Training Courses.

7 Limitations on Seiche Training Ltd Liability; Indemnification

Seiche Training Ltd shall not be liable for death, injury, illness, damage, delay or other loss to person or property of any kind caused by an Act of God, war, civil commotions, labour trouble, terrorism, governmental interference, perils of sea, fire, thefts, or any other cause beyond Seiche Training’s Ltd reasonable control, or any other act not shown to be caused by Seiche Training’s Ltd negligence.

Seiche Training Ltd hereby disclaims all liability to course delegates for damages for emotional distress, mental anguish or psychological injury of any kind under any circumstances, when such damages were neither the result of a physical injury to the course delegate, nor the result of that course delegate having been at actual risk of physical injury, nor intentionally inflicted by Seiche Training Ltd.

Pre-and post-university, course locations, pre-arranged dinner venues and any other venues or vessel tours, shore excursions and any/all connecting ground, vessel or air transportation that Seiche Training Ltd utilizes to deliver their training courses may be owned and/or operated by independent contractors and Seiche Training Ltd makes no representations and assumes no responsibility therefore. If course delegates take part in organized activities, whether on the ship or onshore, course delegates assume the risk of injury, death, illness or other loss and Seiche Training Ltd is not liable or responsible for it.

Where Seiche Training Ltd has arranged accommodation for delegates, Seiche Training Ltd assumes no responsibility or liability for the delegates during their time in said accommodation. Accommodation is operated by independent contractors and Seiche Training Ltd makes no representations and assumes no responsibility therefore. Each course delegate agrees to indemnify Seiche Training for any damages, liabilities, losses, penalties, fines, charges or expenses incurred or imposed upon Seiche Training Ltd as a result of any act, omission or violation of law by the course delegate.

Moreover, Seiche Training Ltd shall not be held liable for any and all indirect or consequential damages, including but not limited to damages to personal image or reputation, loss of business, profit or opportunity, as well as any other damages of similar nature, sustained by the use of, as a result of or in connection with the attending of the course, whether in contract or otherwise.

8 Copyright

All course materials are intended for use by course delegates but remain the property of the original author. Copyright remains with the author and all information used must be appropriately acknowledged or, where indicated (such as the image gallery), permission must be sought from the author and copyright owner.

Photos or visual/audio portrayals of course delegates or course delegates’ likeness used in the course materials are intended for educational purposes and remain the property of Seiche Training Ltd without any compensation being paid to course delegates.

9 Privacy Statement

Seiche Training Ltd only collects personal information when course delegates choose to provide it, for example, in order to register or pay for a course, contribute to an event or subscribe to receive Seiche Training Ltd updates, news or information on upcoming courses. Seiche Training Ltd may have to pass on course delegates’ information to third parties connected to the delivery of the course, which may include but not be limited to; vessel Captains, banks and local venue organizers. Delegates attending the JNCC and BOEM accredited courses are advised that their details will be sent to the JNCC and BOEM as a requirement for their databases.

Seiche Training Ltd will only e-mail registered delegates who have asked to receive e-mail updates/bulletins. Registered delegates can cancel or unsubscribe from any bulletins, news, e-mail updates or future correspondence that Seiche offers at any time by contacting info@seichetraining.com.

Information which a delegate posts on the website (including events and resources) will be available to the public. Otherwise, Seiche Training Ltd will only use or disclose information about course delegates for the purpose for which course delegates provided it (e.g. to respond to a request for information).

10 Training and Events Calendar

Every effort is made to keep the training and events calendar up to date and accurate, however it is subject to change without notice.

11 Payment

All courses require full payment prior to the course commencement date. Delegates are required to either pay a non-refundable deposit of 10% of the course cost when booking via invoice on to a Seiche Training Ltd course or the full balance of the course cost upon completion of the booking via credit card/debit card.

12 Cancellation Policy

In respect of cancellation by Seiche Training Ltd a full refund minus the 10% non-refundable deposit will be given.

Seiche Training Ltd reserves the right to cancel a course at short notice and will not accept liability for costs incurred by participants or their organization for cancellation of travel arrangements and/or accommodation reservations. No liability will be accepted for any other costs.

Seiche Training Ltd will endeavour to provide participants with as much notice as possible, should cancellation or postponement become inevitable. An event may be cancelled or postponed if the number of attendees is less than the minimum number of attendees required.

Seiche Training Ltd reserves the right to cancel a paid event due to unforeseen circumstances. If this occurs, confirmation will be sent 14 days before the event (at the latest) to confirm that the event is being cancelled or postponed. A full refund or transfer (re-scheduling) to another event will be available.

Course fees will cover all teaching, but, unless otherwise clearly stated in Seiche Training Ltd correspondence, marketing materials or on the Seiche website, are exclusive of accommodation, subsistence and travel costs.

In respect of a delegate needing to cancel a course they have booked onto Seiche Training Ltd reserves the right to charge the full course fee for any cancellation by a participant for any reason within 10 days of the start of the training course. If cancellation occurs between 10-21 days, we reserve the right to charge 50% of the course fee. If cancelation is received in writing more than 21 days before the start of the course, seiche training will just charge the admin fees which they have been liable for.

Participant substitutions can be accepted, without charge, at any time if the substitute fulfils the entrance requirement

13 Refund Policy

The course delegate has the right to cancel within 7 days of their booking if they are unable to attend a Seiche Training Ltd course or event. They must contact Seiche Training Ltd by email or other written correspondence and request one of the following options:
a) A full refund of event fees;
b) Transfer (re-scheduling) to another event; or
c) Substitution of another person to attend the nominated event.

Should Seiche Training Ltd cancel a training course for any foreseen reason at short notice then the delegate will be offered a full refund of the course fee, or re-scheduling to another course would be available.
